Limit the Use of My Sensitive Personal Information Request

Under and pursuant to the California Privacy Rights Act (CPRA), this form is for California residents wishing to:
- Opt-out of the sale or sharing of their personal information;
- Limit the use of their sensitive personal information; and/or
- Exercise their rights with respect to their personal information.
Under and pursuant to the Colorado Privacy Act (CPA), this form is for Colorado residents wishing to:
- Opt-out of the collection or sale of their personal information or use of their personal information for targeted advertising; and/or
- Exercise their rights in respect of their personal information.

- Definitions
Under the CPRA, “sell” means: selling, renting, transferring, or otherwise making available personal information to a third party in exchange for money or other consideration.
Under the CPRA, “share” means: sharing, renting, transferring, or otherwise making available personal information to a third party for cross-context behavioral advertising, whether or not money is involved.
Under the CPA, “sale“, “sell“, or “sold” means the exchange of personal data for monetary or other valuable consideration by a controller to a third party. The terms “sale”, “sell”, and “sold” do not include the following: (i) the disclosure of personal data to a processor that processes the personal data on behalf of a controller; (ii) the disclosure of personal data to a third party for purposes of providing a product or service requested by the consumer; (iii) the disclosure or transfer of personal data to an affiliate of the controller; (iv) the disclosure or transfer to a third party of personal data as an asset that is part of a proposed or actual merger, acquisition, bankruptcy, or other transaction in which the third party assumes control of all or part of the controller’s assets; or (v) the disclosure of personal data: (a) that a consumer directs the controller to disclose or intentionally discloses by using the controller to interact with a third party; or (b) intentionally made available by a consumer to the general public via a channel of mass media.
Under the CPA, “targeted advertising“: (a) means displaying to a consumer an advertisement that is selected based on personal data obtained or inferred over time from the consumer’s activities across nonaffiliated websites, applications, or online services to predict consumer preferences or interests; (b) but does not include: (i) advertising to a consumer in response to the consumer’s request for information or feedback; (ii) advertisements based on activities within a controller’s own websites or online applications; (iii) advertisements based on the context of a consumer’s current search query, visit to a website, or online application; or (iv) processing personal data solely for measuring or reporting advertising performance, reach, or frequency.
- Requests
A Do Not Sell or Share My Personal Information request (otherwise known as an opt-out request) restricts your personal information that is subject to the CPRA from being sold to a third party, and from being shared with a third party for cross-context behavioral advertising, if applicable.
A Do Not Collect, Sell or Use My Personal Information for Targeted Advertising request (otherwise known as an opt-out request) restricts your personal information that is subject to the CPA from being collected, from being sold to a third party, and from being used for targeted advertising, if applicable.
- For California residents:
- a Full-Opt-Out request will restrict your personal information from being sold to third parties and from being shared with third parties, with certain exceptions.
- a Partial Opt-Out request will restrict your personal information from being sold to third parties and from being shared with third parties, except any personal information relating to your occupation (professional information) which will continue to be sold to and shared with third parties.
- For Colorado residents:
- a Full-Opt-Out request will restrict your personal information from being collected, from being sold to third parties and from being used for targeted advertising, with certain exceptions.
- a Partial Opt-Out request will restrict your personal information from being collected, from being sold to third parties and from being used for targeted advertising, except any personal information relating to your occupation (i.e., professional information) which may continue to be collected, sold to and used for targeted advertising.
- If you have previously opted-out but have changed your mind, you can submit an Opt-Inrequest, so long as your most recent opt-out request communicated to FlexiVan was more than 12 months ago.
California Residents Only
A Limit the Use of My Sensitive Personal Information request will prevent your sensitive personal information that is subject to the CPRA from being used or disclosed, subject to certain legal exceptions. A Sensitive Personal Information – Full Opt-Out request will limit the use and disclosure of your sensitive personal information subject to certain exceptions.
California’s Shine the Light law also permits you to request certain information about our disclosure of personal information to third parties for their direct marketing purposes.
